Holiday Photo Contest
Just to be sure everyone reads the small print,
if you win the Holiday Photo Contest, you give up your intellectual property rights to said winning photo to the sponsor for $100.00
While this may be fine, and even great, I just want all to be clear.
"Intellectual property rights: by entering the contest, entrants agree to assign their intellectual property rights to sponsor and permit sponsor to use the photos in any media, including the internet, for any purpose whatsoever. Entrants who do not agree to this use should not enter this contest."

Well I suppose that’s the ultimate interpretation
But from our end ..
We’re really just trying not to get our butts in jam .. if we can’t contact the winner next year … and then they see their photo being used for promotional purposes and get in a tizzy ..
I view the holiday contest as a way to attract new people and introduce them to byte and as such I market it on other sites to try and attract entries … but with the litigiousness these days .. I feel a strong need to be clear .. that in the event they win we’re going to use their photo for promotional purposes here at byte and ‘other sites’ ..
But at the end of the day do I want their photo for anything other then to promote sites that we own .. NO
… you’re not going see us selling prints of the winning photo on ebay or anywhere else for that matter
I think most here would agree that we have been very diligent in our respect of the photographers photos here at byte ….
Btw : I knew this question was coming and I’m glad you asked … hopefully most will understand my intentions a little better now ..

Paul,
I certainly did not mean to put that in any way shape or form as negative.... simply informative... I think it's wonderful that you are offering a cash prize for the winner. This site has been great to me and all in the past, and seems to be taking great leaps forward now.
Hence the comment about it being good, even great......
Again, just trying to help.... not everyone reads all the print... and surprises happen that way.
Thanks for all your diligent hard work, it sure is showing!!! ;)

shootem .. no offence taken here ..
you are a very respected member here at byte … with a very justifiable question .. and I’m very glad you have asked it ..
If I sounded upset I’m not .. .. I’m just very tried .. with still a good amount of work to do before I can call it a night ..

Hmmm, so we win the contest, give up all rights, and then may find our image on a Hallmark card making a lot more than $100. Interesting.

Don't think so..... as Paul said, it's so Bytephoto can use your image for advertising, to show off the quality on this site. In other words...
Win the contest, get $100, and see your image on the site, or used for advertising the site. Pretty good deal unless you plan on selling it elsewhere and you have the connections to do so.....and if that's the case, you wouldn't want to enter. My only purpose of starting this, was so everyone is aware — I know some just don't read all the specs.

Ha … I wish I had the connections to sell to hallmark .. I’d spilt the $$ with you ..
You do have a valid concern … and I think that I have been forthcoming with my reason for the disclaimer ...
btw .. we’d love to have your entry .. but if you are uncomfortable with the thought of your image being used to promote the site I understand and respect your position …
